Many workers’ compensation clients are unsure what to expect when their case goes to a hearing. Here’s an inside look at a recent Expedited Hearing where we represented one of our clients, Ms. R, at the Santa Ana Workers’ Compensation Appeals Board.
Why Was the Hearing Scheduled?
This particular hearing was requested to address an important issue in Ms. R.’s case: obtaining an additional Qualified Medical Evaluator (QME) panel in psychiatry. Ms. R has been suffering from some mental health issues as a result of her injury, but as is often the case, the insurance company was refusing to allow complaints to receive a proper evaluation.
What Happened During the Hearing?
Much of the hearing focused on resolving the issue of the additional QME panel. After discussing the issue with the defense counsel and the Judge, a consensus was reached that Defendant had a losing argument and they simply agreed to jointly request the additional panel. We then executed the necessary forms immediately, saving time and ensuring Ms. R. could move forward with her case.
Was a Settlement Discussed?
Settlement is often a key topic during workers’ compensation hearings, even hearings where settlement is not explicitly the reason for the hearing. This case was no different. The opposing party proposed a settlement a six-figure settlement to resolve Ms. R.’s case. While no decision was made at the hearing, we discussed the idea of settlement in general terms. Ms. R. is now considering whether settlement might be the right option for her, taking into account her current treatment and future needs. What’s Next?
With the additional QME panel now agreed upon, Ms. R. can move forward with securing the medical evidence needed to support her claim. At the same time, we’ll continue discussions about settlement and keep her informed every step of the way. We will even engage in a negotiation process with the defense counsel to maximize her settlement.
